Last or Only Child
For cases involving a single child, or one remaining minor child, any order for income assignment for current child support shall be terminated once the child turns 18 years of age and has graduated from high school or age 19 if the child is pursuing an accredited course of instruction leading to the acquisition of a high school diploma or its equivalent. Unless an Order exists which provides a specific date for termination of child support, Waukesha County Local Court Rule 3.2 provides income assignments for current child support shall be terminated on May 31st following the last or only child's 18th birthday. This assumes that most children turn 18 in the calendar year before their spring (May or June) graduation. The court understands that there are exceptions and provides a form and instruction for the following two exceptions:
If the parties do not exercise the option(s) below, the income assignment will continue until May 31st following the child's 18th birthday. If this is acceptable, we recommend that you call the Child Support Division to verify that May 31st has been entered as the end date for current support. Please also keep in mind that even though the current support will end, the income assisgnment will continue if/when there are any outstanding arrears, interest, or adminstrative fees due unless otherwise ordered by the court.
