You've Been Served!

If your spouse has filed for divorce and had you served with divorce or legal separation papers, you are required to complete and file certain forms and complete certain tasks. Requirements are different for those who have filed with minor children and for those who file without minor children. The Summons and Petition will indicate which type of filing is involved.

Below you will find the Basic Guide to Divorce, instructions for filing (referred to as the Procedural Checklist), Tips for Representing Yourself in Family Court, and all the forms you will need to get from the beginning to the end of the divorce process.  You also have the option to:

  • Print the forms in PDF or
  • Complete the Word Fillable forms on-line

Please keep in mind that not all forms are due at the same time. Review the Procedural Checklist (we recommend that you print it and keep it with your papers) to determine in what order to complete each form and other tasks required.

  • 20 minutes of free legal advice with a volunteer attorney.
  • Eligibility requirements: Individuals with a Waukesha County Family Court case, do not have an attorney, have never utilized the Family Legal Clinic before, have family court related legal questions, and are in need of assistance. ​
