Conversion of Legal Separation to Divorce

Your legal separation was granted, but now you want a divorce?  You don't need to file for divorce and go through the enitre process again, but there is a specific process you must follow to achieve the conversion. There are two ways to convert the legal separation into a divorce:

  1. By stipulation:  At any point in time after the legal separation is granted, the parties may agree to convert the legal separation into a divorce.
  2. By motion:  After one year has passed since the legal separation was granted, one party may file a motion to have the legal separation converted to a divorce. 

The packet below includes both options above.  Keep in mind however, that these forms do not allow the parties to change or enforce the original Judgment.  If there are changes or a party needs assistance enforcing an order, he/she will have to file post judgment actions.
