Mandatory Mediation

Pursuant to Judge Davis’ Order dated July 31, 2012, all Waukesha County contested Small Claims matters are ordered to proceed thru mediation.

For all contested cases, after the Defendant files their written Answer with the court, the Plaintiff is required to initiate scheduling mediation within 10 business days of the filed Answer. The parties may use any mediator they wish. However, if they do not agree on a mediator, the Mediations Center of Wisconsin Community Services is to be used. Information below:

The above Center, a nonprofit United Way funded program, charges a nominal fee to cover costs, payable at the time of mediation.

The cost of mediation will be equally divided between participants.

All parties will personally appear at mediation (Corporate parties may appear by counsel). The mediation process is to be completed at least 10 business days prior to any scheduled contested hearing/trial. Failure to cooperate will be grounds to grant judgment for or against the offending party.
