Delinquency Matters

Delinquency Matters are court proceedings for juveniles (at least 10 years old but not yet 17) where they are believed to have violated a criminal law. Attorneys from the Waukesha County District Attorney's office prosecute delinquency matters with the filing of a formal Petition for Delinquency.

 

Juvenile Restitution

Acceptable forms of payment include Discover, MasterCard, or Visa credit or debit cards.  Please note a 2.75% service fee will be assessed for payments using a credit or debit card.

To request that unpaid restitution be converted into a money judgment.  Used by a victim, insurer, or representative of the public interest. This petition may be filed if:

(1) it’s unlikely the restitution will be paid before the end of the order, or

(2) after the expiration of the deferred prosecution agreement, consent decree or dispositional order under which the restitution is payable, but no later than one year after the expiration, or any extension, of the order.

Collections Methods Available to Victim once Civil Judgment is Entered: The victim has the option of using any collection method available to other judgment creditors to collect (garnishment, execution, etc.).

Note: If the victim chooses to file a garnishment action, it cannot be done in the delinquency case.  Instead, a SC or CV case should be opened, depending on the amount to be collected, using the appropriate garnishment class code.
