Mandatory Mediation
Pursuant to Local Rule 6.4, all Waukesha County contested Small Claims matters are ordered to proceed through mediation. The Waukesha County Circuit Court Civil Division has designated Waukesha Mediations as the default mediators for small claims cases. Within ten (10) calendar days of receiving the Notice of Hearing from the Clerk of Circuit Court, the party filing the case must contact Waukesha Mediations and schedule mediation with the adverse party(ies). Failure to initiate the scheduling of mediation timely may be grounds for dismissal. The cost of mediation will be divided equally between the parties.
For all contested cases, after the Defendant files their written Answer with the court, a hearing will be scheduled. Upon receipt of the Notice of Hearing, the Plaintiff is required to initiate scheduling mediation within ten (10) business days.
Pursuant to Local Rule 6.4, the parties may use any mutually agreed upon mediator. If the parties cannot mutually agree upon a mediator, pursuant to the Small Claims Mediation Order 2.19.2026 effective February 23, 2026, the parties may use Marquette Mediation Clinic for claims under $5,000.00 (free of charge) or Waukesha Mediations for ALL Small Claims including when Marquette Mediation Clinic is not available. If a party wishes to use a private mediator other than Waukesha Mediations or the Marquette Legal Clinic, BOTH parties must voluntarily consent to use said private mediator, and obtain written consent. Said written consent shall be filed with the Court prior to the scheduling of the mediation. The parties shall use this Consent of Parties to Private Mediator Form. Any private mediation report filed will not be considered compliant with Local Rule 6.4 without the Consent form being signed by all parties and filed with the Court.
