Request to Reschedule Guide

The Request to reschedule is used to ask the Court to reschedule or postpone a future hearing or court appearance. Either party may make the request, but the court may review the request more quickly if both parties are in agreement. If the parties are not in agreement, the request must be made no less than 10 business days before the scheduled court date.

Procedural Checklist

  1. Complete the Request to Reschedule.
  2. If the other party did not sign the request, also complete the Five-Day rule Fillable Letter.
  3. Come to the Family Division Office between 8:30 am and 4:00 pm, Monday through Friday, to have your form reviewed for completeness.
  4. Make three (3) additional copies (4 if the State is a party). You can make your own copies in the Family Division Office for $.25 per page on the coin-operated copier. Please bring cash as it accepts $1, $5, $10 bills and coins only.
  5. If both parties signed the request (and the State also approves, if a party), file the original with the court and distribute the remaining copies to the other party(s).
  6. If you are making this request alone:
    • Mail a copy of the Request to Reschedule and the Five-Day Rule fillable letter to the other party
    • Complete the Affidavit of Mailing (FA-4121)
    • File the original Request to Reschedule, a copy fo the Five-Day Rule fillable letter, and Affidavit of Mailing with the court.
  7. If in agreement: Shortly after receiving the form, the court will review it, and if appropriate, will set a new court date.
    If not in agreement: The court will hold the Request under the 5-Day Rule. If the other party makes no objection, the court will review it, and if appropriate, will set a new court date.
  8. If granted, you and all parties will receive a copy of the the signed request and a Notice of Hearing from the Court. If not granted, you and all parties will receive a notice of such should appear at the court date as previously scheduled.

Any questions regarding the status of the request should be made by contacting the Court Official's Calendar Clerk. If you DO NOT receive a notice from the court either denying or granting your request, you must appear at the court date as previsously scheduled.

  • 20 minutes of free legal advice with a volunteer attorney.
  • Eligibility requirements: Individuals with a Waukesha County Family Court case, do not have an attorney, have never utilized the Family Legal Clinic before, have family court related legal questions, and are in need of assistance. ​
